The Equality Act 2010 does not specify how public authorities should analyse the effect of a new or revised policy or a service change, and has changed the terminology from 'equality impact assessment' to 'analysis of the effects on equality'. 

We have taken a decision to continue to conduct this analysis through completion of an Equality Impact Assessment tool.  The tool and guidance are being revised, particularly to incorporate changes to have a more rigorous ratification process.

What is an Equality Impact Assessment?
An Equality Impact Assessment (EIA) is a way of checking what effect a new or revised policy or a change to a service may have on different groups of people/protected characteristics.

What's the process?
An initial screening is carried out to decide if any part of the policy or service change is likely to have a big effect on equality for any group or groups.  This might be either a positive impact or negative impact.  This is about analysing the effect on equality for all of the protected characteristics and all the aims f the general duty [with the exception of marriage and civil partnership, where only discrimination applies].

If the screening process shows that a negative impact is likely then a full EIA will be carried out to determine the extent of the impact and to consider what changes or practical measures can be put into place to remove or minimise disadvantage; or to meet particular needs, such as through providing services for particular groups. 

What should be analysed?

  • New policies
  • Existing policies when they are reviewed
  • Service changes / developments
  • Effects on equality of how a policy is implemented by the Trust when it was developed externally, e.g. a DH policy
  • Where required to implement a decision over which the Trust has no control, e.g. a reduction in funding that may be decided elsewhere will still require consideration of mitigating measures or alternative ways of doing things to minimise the impact on services and equality groups.
